These terms do not affect our liability under any contract we enter into with you resulting from a booking, which will be subject to separate booking conditions or terms and any exclusions or limitations of liability therein.

For consumers, we do not limit or exclude our liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.

The exclusive venue for any action concerning these terms or any grievance relating to the tour shall be solely in the state or federal courts located in Ocean County, New Jersey. This Agreement shall be construed according to the internal laws of the State of New Jersey without regard to conflicts of law principles. All guest claims must be submitted in writing and received by Wherever Tours no later than 60 days after the completion of the tour. Guest claims not submitted and received within this time shall be deemed to be waived and barred. In any legal action, arbitration, or other proceeding, the prevailing party shall be entitled to recover actual reasonable attorneys’ fees, costs, and expenses.

18. User-Generated Content

These terms apply to our use of any user-generated content ("Content") uploaded, posted, or shared on third-party websites or social media platforms (like Instagram, Facebook, Pinterest, YouTube, and Twitter) that we use on our platforms, website, and promotional materials. We reserve the right to alter these terms without notice. Review them each time you grant permission to feature your Content.

Our Right to Use the Content

18.3 Personal Information

Submitted Content is deemed non-confidential, and we have no obligation to maintain its confidentiality.

18.4 General

• You confirm being at least 18 years old.
• You confirm being the original creator of the Content and having no knowledge of it being created by someone else.
• You grant us the right to use your username, image, or other identifying information in connection with your Content.

• We may accompany imagery with your username and the original posting date, but we are not obligated to do so.
• You retain ownership of the Content, granting us only the rights to use it for marketing.
• To relinquish granted rights, contact us in writing with the Content, its location, and proof of ownership. We will remove it where reasonably possible.
• You waive any payment for Content use across all mediums and channels.
• You release us from any claims or demands related to Content use.
